Estate, Trust, Asset and Incapacity Planning
The first and most important thing to do in planning for incapacity, old age or disability is to talk to your family and your doctor. Make sure they know in no uncertain terms what your wishes and desires are regarding your treatment and the use of your money and property and any other things you feel are important.
If you feel you may require additional assistance or that your family disagrees with your position or that your family will not be particularly helpful in carrying out your desires, you may wish to talk to a lawyer who can help you prepare the documents necessary to carry out your desires.
There are several things you can do that will assist you in preparation for possible incapacity. A durable power of attorney allows another to handle your affairs during your incapacity. If you want more information on this document, please read Powers of attorney.
If your estate is large enough, you may wish to prepare a living trust, which allows you to manage your affairs while you are still able, and then appoints a successor trustee to handle matters when you are no longer able to do so.
A living Will sets out your wishes regarding your medical treatment. It can also spell out just how far you want your doctor to go in prolonging your life. You should also have a Will which states who is to receive your property upon your death.
